This webinar will identify and delve into emerging and developing issues in cybersecurity and privacy class actions. Discussion will include 10b-5 issues facing public companies arising out of data breaches, issues of standing in session replay, data breach and Video Privacy Protection Act class actions, emerging and developing TCPA and BIPA issues and “inclusion upon seclusion” claims.
Subjects that will be discussed include securities and 10b-5 issues facing public companies arising out of data breaches; issues of standing in session replay, data breach and Video Privacy Protection Act class actions; emerging and developing issues in Telephone Consumer Protection Act (TCPA) cases; emerging and developing issues in Biometric Information Privacy Act (BIPA) cases; and intrusion upon seclusion claims facing data brokers.

Todd McClelland is a partner in Sterlington’s Cybersecurity, Data Privacy, AI and Litigation practices. McClelland advises companies on complex, international legal issues associated with cybersecurity breaches and compliance, data privacy compliance, and data, technology, cloud, and outsourcing transactions. McClelland has handled some of the largest and most well-known (and unknown) cybersecurity incidents, as well as pre-breach cyber activities. He counsels clients in many industries, including payment processors, cybersecurity product providers, retailers, petro companies, financial institutions, and traditional brick-and-mortar companies. Prior to his legal career, McClelland was an engineer designing and programming industrial control, robotics, and automation systems.
Ian Ross is a partner at Sidley Austin, where he represents clients in business disputes, commercial and securities litigation, government investigations, and class actions. Ross has extensive experience defending his clients in high-stakes commercial and securities litigation, nationwide class actions, shareholder derivative suits, breach of fiduciary actions, state securities actions, and government investigations. He has defended his clients through trial in cases involving challenging financial, corporate governance, and damages issues.
