Likes & Laws: Social Media Influencer Compliance, Risks, and Pitfalls

Marketing has a new weapon: social media influencers. Influencers drive millions of dollars in revenue, but attempts to mitigate the risk inherent with their use are often stuck in the MySpace era. Whether your company uses influencers, you are an influencer, or you just need someone to explain what an influencer is this is the program for you. Topics discussed will include requirements for sponsored posts, influencer agreements and their critical provisions, influencer intellectual property considerations, combating faked engagement, and morality clauses.

Talia Boiangin is an associate at Greenberg Traurig. Boiangin advises clients on technology contracts, data privacy, and protection, and other legal matters at the intersection of law and technology. In her transactional practice, she structures, drafts, and negotiates privacy policies, collaboration agreements, vendor and sales agreements, internet and e-commerce transactions, terms of service, products and services agreements, and other corporate operational transactions. Boiangin counsels clients on privacy, data, and security matters, including GDPR, CCPA, CPA, and VCDPA readiness. Tyler J. Thompson has designed and implemented privacy programs for clients from Fortune 500s to start ups, ensuring those clients are compliant with U.S. and international privacy laws. he also advises on data retention and minimization, privacy by design, data inventories, and privacy impact assessments. Thompson is accredited by the American Bar Association and the International Association of Privacy Professionals (“IAPP”) as a Privacy Law Specialist.
