Environmental Law Goes Retro: Learning Foresight from Hindsight

Jonathan B. Wiener is the Perkins Professor of law, environmental policy and public policy at Duke University, where he co-directs the program on “Rethinking Regulation,” and helped create the Nicholas Institute for Environmental Policy Solutions. He is a past president of the Society for Risk Analysis (SRA), a member of the scientific committee of the International Risk Governance Council (IRGC), and a University Fellow of Resources for the Future (RFF). In 2012, he co-chaired the World Congress on Risk held in Sydney. His publications include the books Risk vs. Risk (Harvard University Press, 1995); Reconstructing Climate Policy (AEI Press, 2003); The Reality of Precaution: Comparing Risk Regulation in the United States and Europe (RFF Press/Earthscan/Routledge, 2011); and Policy Shock: Regulatory Responses to Oil Spills, Nuclear Accidents, and Financial Crises (forthcoming). He was a co-author of the Intergovernmental Panel on Climate Change (IPCC), 5th Assessment Report (AR5), WG III, chapter 13 on “International Cooperation” (2014). He is a member of the special policy study team of the China Council for International Cooperation on Environment and Development (CCICED) on “Environmental Risk Management” for China (2015). Before coming to Duke in 1994, he served at the US Department of Justice Environment and Natural Resources Division (DOJ/ENRD), the Office of Science and Technology Policy (OSTP), and at the President’s Council of Economic Advisers (CEA); there he helped negotiate the Framework Convention on Climate Change (FCCC) (1990-92), helped draft Executive Order 12866 on regulatory review (1993), and helped launch the Americorps National Service Program (1993). During 1987-89, he was a law clerk to federal judges Stephen G. Breyer and Jack B. Weinstein. He is a graduate of Harvard University (AB in economics, 1984; JD, 1987), where he was a research assistant at the National Bureau of Economic Research and an editor of the Harvard Law Review.
