FSU Law Associate Dean Jake Linford and Terry Sanks, founding member of Beusse Sanks, will discuss the current state of AI litigation and settlements in intellectual property cases.
This webinar explored how the landscape of AI intellectual property litigation has transitioned from theoretical debates to high-stakes judicial precedents and watershed settlements. Two key cases determined that training large language models (LLMs) on lawfully acquired data constitutes "highly transformative" fair use, resulting in summary judgment rulings in favor of Anthropic and Meta in late 2025. However, this legal "safe harbor" may evaporate when pirated datasets are involved; the historic $1.5 billion settlement in Bartz v. Anthropic—predicated on the use of "shadow libraries"—serves as a stark warning of the multi-billion dollar liability facing developers who bypass legitimate licensing channels. In some cases, the focus is shifting from the act of training to "output liability," while major media and entertainment entities lead a new wave of litigation targeting both generative models and Retrieval-Augmented Generation (RAG) platforms.
